customer's needs for the period of 2026.\nIn accordance with Part 1 of Article 5 of the Law of Ukraine \"On Natural Monopolies\" dated 20.04.2000 No. 1682-\u0406\u0406\u0406, the activities of natural monopoly entities in the following areas are regulated: transportation of thermal energy.\nIn accordance with Part 2 of Article 5 of the Law of Ukraine \u201cOn Natural Monopolies\u201d dated 20.04.2000 No. 1682-\u0406\u0406\u0406, a consolidated list of natural monopoly entities is maintained by the Antimonopoly Committee of Ukraine on the basis of registers of natural monopoly entities in the housing and communal services sector, which are formed by the national commission that carries out state regulation in the field of communal services, and in other areas in which natural monopoly entities operate, by national commissions for the regulation of natural monopolies in the relevant area or by executive authorities that carry out the functions of such regulation prior to the creation of the said commissions.\nThe municipal enterprise of the Bila Tserkva City Council \"Bila Tserkva Heat Network\" holds a monopoly position in the market for the supply of heat energy in the territory of the Kyiv region, in particular, in the city of Bila Tserkva, which is confirmed by the Consolidated List of Natural Monopolies, which, in accordance with Part Two of Article 5 of the Law of Ukraine \"On Natural Monopolies\", is compiled and maintained by the Antimonopoly Committee of Ukraine in accordance with its powers (Order of the Antimonopoly Committee of Ukraine dated 28.11.2012 No. 874-r \"On Approval of the Procedure for Compiling and Maintaining a Consolidated List of Natural Monopolies\", registered with the Ministry of Justice of Ukraine on 19.12.2012 No. 2119/22431), namely: The municipal enterprise of the Bila Tserkva City Council \"Bila Tserkva Heat Network\" is located under number 287 in the Consolidated List of Natural Monopolies as of November 30 2025.\nThe municipal enterprise of the Bila Tserkva City Council \"Bila Tserkva Teplomerezha\" has a license to conduct economic activities in the supply of thermal energy (Resolution of the National Commission for the Regulation of the National Energy and Power Sector No. 36 of 29.03.2013), a license to conduct economic activities in the transportation of thermal energy through main and local (distribution) thermal networks (Resolution of the National Commission for the Regulation of the National Energy and Power Sector No. 36 of 29.03.2013).\nAlso, in accordance with the decision of the Bila Tserkva City Council dated 23.12.2005 N 388 \"On determining the service provider\" (based on the Law of Ukraine \"On Housing and Communal Services\", the Rules for the provision of services for centralized heating, supply of cold and hot water and drainage and the standard contract for the provision of services for centralized heating, supply of cold and hot water, approved by the resolution of the Cabinet of Ministers of Ukraine dated 21.07.2005 N 630), the Municipal Enterprise of the Bila Tserkva City Council \"Bila Tserkvateplomerezha\" was determined as the provider of services for centralized heating and hot water supply in the housing stock of communal property of the city of Bila Tserkva.\nThe Customer's networks are connected directly to the facilities of the Municipal Enterprise of the Bila Tserkva City Council \"Bila Tserkva Heat Network\", which, in turn, is a subject of natural monopolies, there is no alternative to supplying heat energy by another supplier for technical reasons, and connection to other sources of heat supply is not justified by technical capabilities.\nIn connection with the above, heat energy supply services can be provided exclusively by the Municipal Enterprise of the Bila Tserkva City Council \"Bila Tserkva Heat Network\" due to the lack of competition for technical reasons.\nAt the same time, as provided for by current legislation, when making purchases, customers must adhere to the principles of public procurement.\nThus, taking into account the above, in order to comply with the principle of procurement efficiency, to ensure the Customer's current needs as soon as possible under martial law, the Customer has decided to carry out the Procurement without the use of open bidding and/or an electronic catalog for the procurement of goods and to apply, as an exception, the grounds under subparagraph 5 of clause 13 of the Features during the Procurement: the purchase by the Customer of goods and
